ARTICLE 1 – SCOPE

These general conditions of sale (hereinafter "GTC") apply, without restriction or reservation, to all products offered for sale by SAS PETIT FAUNE, a simplified joint-stock company with a capital of 39,999 euros , having its registered office at 55 rue de Babylone, 75007 Paris, registered with the Paris Trade and Companies Register under number 750 525 081 (hereinafter referred to as "petitfaune") on its Website www.petitfaune.com (ci - after referred to as the Site). These products (hereinafter "the Product(s)"), marketed under the brand name "petit fauna" (hereinafter referred to as "the Brand"), are as follows:

1.1. Ready-to-wear

- children's clothing and accessories: layette, jumpsuit, overalls, jumper, onesie, romper, cardigan, dress, trousers, blouse, bodysuit, bloomers, jacket, bra, wrap-over top, overalls, bloomers, skirt, shirt, shorts, blouse;

- children's accessories: bonnet, mittens, slippers;

1.2. Ready-to-create:

- sewing patterns, knitting patterns, buttons, wool, fabrics, labels,

without this list being exhaustive.

Consequently, when you order a Product on the Site, under the conditions defined in article 4 below, you fully and entirely accept the T&Cs which you acknowledge having read prior to ordering.

petit faune reserves the right to adapt or modify the T&Cs at any time. From the date of posting of a new version, the fact for any person to order a Product implies full and complete acceptance of the new version of the GCS which he acknowledges having read prior to the order.

ARTICLE 2 - COMMITMENTS

2.1. Your commitments

Prior to your order, you declare:

- that the purchase of Product on the website is not directly related to your professional activity and is limited to strictly personal use;

- that sewing and knitting patterns are purchased for private use only. Any public use of these pattern models, any reproduction, representation, adaptation and/or exploitation, in any way and in any form whatsoever, is strictly prohibited without the prior authorization of Petit Faune;

- that you have specific rights, which would be called into question in the event that the Products acquired as part of the “petit faune” online store were made in connection with your professional activity;

- have full legal capacity allowing you to engage under the GCS.

2.2. Small Fauna Pledges:

little faun gets involved:

- to present and describe the products accurately in order to “put the consumer in a position to know the essential characteristics of the goods in accordance with article L.111-1 of the Consumer Code. However, Petit Faune cannot be held liable for any errors that may have occurred on the website following, in particular, connection problems or poor transcription of the page (visual or text);

- in the event of acceptance of an order, to sell to you and have delivered to you the Products that you have ordered in accordance with these GCS.

ARTICLE 3 – CREATION OF A CUSTOMER ACCOUNT

Any new Petit Faune customer must, prior to ordering or during ordering, create an account by entering their contact details (surname, first name, postal address, email address, telephone number) and a password.

The personal data thus recorded and processed are subject to the provisions of Article 15 below

ARTICLE 4 – ORDERS

When placing your order, you will have the opportunity to check the details of the order as well as its total price and to correct any errors, before confirming it by validating the order summary screen to express your consent, and proceed to its payment.

Clicking on the “Pay now” link is assimilated to the handwritten signature referred to in article 1341 of the Civil Code and constitutes full and complete acceptance of the GCS, prices, volumes and quantities of the Products ordered.

As of this last click, the order is irrevocable and can only be called into question in the limited cases provided for below.

petit faune then sends you an e-mail confirming your order, it being specified that this e-mail only confirms that the order has been taken into account by petit faune, and not that the Product ordered is available.

ARTICLE 5 – ARCHIVING OF TRANSACTIONS

The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy, in accordance with article 1348 of the Civil Code.

All the data recorded and stored in the computer systems of petit faune, under reasonable security conditions, constitutes proof of communications and transactions between petit faune and yourself.

ARTICLE 6 – OFFER AND AVAILABILITY OF PRODUCTS

Our Product offers are valid as long as they are visible on the website within the limits of available stocks. The photos that may represent the Products, have only an indicative value due to the alterations that may exist due to their transcription on the site.

On receipt of your order, we check the availability of the Products ordered.

In the event of unavailability of all the Products in your order, we undertake within 30 days from the validation of your order under the conditions provided for in Article 4 above, either to offer you a new delivery date that you must confirm within 7 days, or to cancel your order and refund the full price of the order by check.

In the event of partial unavailability (unavailability of only part of the products in your order), we undertake to deliver to you within 30 days the available Products in your order as well as an information message and a partial refund check.

ARTICLE 7 - SIZES AND MEASUREMENTS

Brand clothes fit the age of the child.

ARTICLE 8 – PRICES

All the prices indicated on the site are in euros including VAT, excluding transport costs.

For deliveries outside France, the provisions of the General Tax Code relating to VAT apply.

petit faune reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated to you at the time of your order, subject to the availability of the Products ordered on that date.

ARTICLE 9 – TERMS OF PAYMENT

You can pay with one of the following bank cards: VISA, Mastercard or American Express.

In this respect, you guarantee petit faune that you have the necessary authorizations.

Payment for your order is made securely using the 3D Secure system.After the validation of your bank details (card number, expiry date and cryptogram), a new page will be displayed on which you will have to enter the personal information requested by your bank This information can be:

- the answer to a personal question;

- a password you chose beforehand;

- a code sent by SMS,

- your date of birth...

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation email.

Authentication is specific to each bank. For any questions regarding your 3D Secure code, we invite you to contact your bank directly.

The shipment of your order can only take place after verification of your method of payment and receipt of the authorization to debit your card. Your account will be debited when your Order is shipped.

petit faune reserves the right to suspend or cancel any order and/or delivery in the event of a payment incident.

ARTICLE 10 – DELIVERY

Orders are delivered by carrier, with a fixed contribution to the cost of sending and making the package. The delivery time will depend on the availability of the products as well as the necessary bank checks. In case of delay, you will be contacted by phone or e-mail.

After validation of your order, we prepare your package and send it within seven days. The Products always travel at your own risk. You must check the good condition of the Products upon arrival of the package and you have 48 hours to make any reservations with the carrier in the event of missing items or damage.

ARTICLE 11 - DELIVERY COSTS

The delivery costs, at your expense, are calculated at the time of your purchase according to the volume and your delivery address.

ARTICLE 12 – RIGHT OF WITHDRAWAL

In accordance with Article L.121-20 of the Consumer Code, you have a period of 7 days from the date of delivery of your order to exercise your right of withdrawal, return the Products to you not suitable, and request a refund without penalty, with the exception of return shipping costs.

The return of the Product must be made to the following address:

little faun, 55 rue de Babylone, 75007 Parist.

This right of withdrawal cannot under any circumstances apply if the Product delivered is not in perfect condition and as delivered by petit faune.

In particular, the Product must be returned correctly protected, in its original packaging, in perfect condition for resale (undamaged, damaged or soiled) accompanied by any accessories, as well as the original invoice of sale, of which you will keep a copy. Packages for which no attached element does not identify the sender (order number, surname, first name and address) cannot be taken back.

We undertake to make you an exchange – within the limits of available stocks, a credit note, or a refund within a maximum period of 30 days after exercising your right of withdrawal, in return for the return of the Product. No cash on delivery will be accepted for any reason.

There will be no exchange or refund of a garment that has been sewn by the Customer from a sewing pattern. Only the return of the sewing pattern, in perfect condition for resale as just mentioned, as well as the fabric, wool, buttons and labels relating to the pattern model sold will be exchanged or refunded as specified above.

ARTICLE 13 – GUARANTEES

131 Legal guarantee of conformity

In accordance with Articles L.211-4 to L.211-14 of the Consumer Code, you benefit from the Product conformity guarantee.

Thus, to comply with the contract, the Product must in particular be suitable for the use usually expected of a similar product and, where applicable, correspond to the description given by petit faune on its Site.

The action based on the legal guarantee of conformity must be brought within two years from the delivery of the goods.

You must make any complaint to us about apparent defects or the non-conformity of the product delivered by sending an e-mail via the "Contact Us" section of the Site. We are committed to remedying this problem as soon as possible.

Failing this, non-compliant Products will be exchanged – within the limits of available stocks – or refunded. However, no Product may be exchanged or refunded before it has been reshipped and received by Petit Faune, as delivered by the latter, taking care to attach the original sales invoice.

The refund or delivery of new Products by petit faune will take place within 30 days of receipt of non-compliant products or products with visible defects. In this case, the reimbursement or the delivery of new Products will not give rise to any costs to be borne by you.

13.2 Legal warranty against hidden defects

In accordance with article L.211-13 of the Consumer Code, you also have the right to exercise the action resulting from latent defects as it results from articles 1641 to 1649 of the Civil Code.

The action based on the legal warranty against latent defects must be brought within two years of the discovery of the defect.

You must make any complaint to us about the hidden defects of the Product delivered by sending an e-mail via the Contacts section of the brand's website.

In the event of hidden defects, Petit Faune will reimburse you for the price of the Product as well as the cost of returning the Product.

ARTICLE 14 – RETENTION OF OWNERSHIP

petit faune expressly reserves ownership of the Products delivered until full payment of their price in principal and interest.

The above provisions do not prevent the transfer to your responsibility of the risk of loss or deterioration.

In the absence of full payment, Petit Faune will be entitled to demand the return of the Products delivered. The costs that may be incurred for this return will be your responsibility.

ARTICLE 15 - DATA PROTECTION AND FREEDOMS

We reserve the right to collect personal data concerning you, in particular when creating your customer account and when using cookies.

This data cannot be communicated to third parties without your prior authorization.

Furthermore, these data are only intended for Petit Faune to process your order and to improve the services offered on the website (communication by email of information, personalization of the website according to your preferences ).

However, we reserve the right, for commercial reasons, to transmit your identity and contact details to a commercial partner, after having informed you and given you the opportunity to exercise your right of opposition.

You are informed that this processing of personal data has been declared to the Commission Nationale de l'Informatique et des Libertés under number 1277393.

Furthermore, and in accordance with the “Informatique et Libertés” law of January 6, 1978 amended by the law of August 6, 2004, you have the right to access, modify, rectify and delete personal data. about you

ARTICLE 16 – RESPONSIBILITIES

16.1. Responsibility for the online sales process:

petit faune, in the online sales process, is bound only by an obligation of means. In particular, it cannot be held liable:

- for damage resulting in particular from the use of the Internet network such as loss of data, intrusion, virus, service interruption,

- in the event of force majeure or fortuitous events, including, but not limited to, total or partial strikes, in particular by La Poste, disasters, fires, failures or breakdowns of the Internet, telecommunications or electrical network, or intrusion outside or presence of computer viruses, and in general any event that does not allow the proper execution of commands.

16.2. Liability for Products sold:

Subject to mandatory legal provisions, the liability of "small fauna" cannot be engaged:

- in the event of an error in one of the photographs or one of the texts illustrating the products;

- in the event of damage of any kind, both material and immaterial, which may result from the misuse of the products;

- in case of out of stock or unavailability of the product;

- in case of incorrect execution of the sewing pattern. In any case and without limiting the previous stipulations, the liability of Petit Faune will be limited to the sums paid or payable at the time of the order at the origin of the said liability, whatever the cause or the form of the action concerned. t3>

ARTICLE 17 – INTELLECTUAL PROPERTY

All the elements of the website, and in particular the texts, comments, illustrations and images, whether visual or sound, are protected by intellectual property rights and are and remain the exclusive intellectual property of petit faune. It is strictly forbidden to reproduce, imitate, exploit, distribute or use for any reason whatsoever, even partially, elements of the website, without having obtained the prior written authorization of petit faune.

The above stipulations also apply to any use, in particular for advertising or promotional purposes, of the name and logo of Petit Faune.

If you have a personal website and you wish to place, for personal use, on your site, a link directly to the website, you must request the prior written authorization of Petit Faune.

In any case, any unauthorized link must be removed at the request of little faun.

petit faune is also the holder of all the intellectual property rights attached to the Products.

Any reproduction or imitation of the Products without the authorization of Petit Faune is therefore strictly prohibited.

ARTICLE 18 - DURATION

The T&Cs apply for the entire duration of the online posting of the Products and services offered by petit faune on its Site.

The T&Cs are subject to French law.
